ABUJA, NIGERIA – The iNews Times | Mohbad death investigation court case took a decisive turn on Monday as Justice James Omotosho of the Federal High Court in Abuja fixed May 28 for hearing in a suit seeking to compel the Nigeria Police Force (NPF) to reopen and properly conclude investigations into the circumstances surrounding the death of popular musician, Ilerioluwa Oladimeji Aloba, widely known as Mohbad.

The suit, instituted by a non-governmental organisation under the aegis of the Registered Trustees of Break the Silence Foundation, is pressing for a judicial order that would mandate the police to carry out what it describes as a thorough, diligent, impartial, and professional reinvestigation into the controversial death that occurred in Lagos in September 2023.

Following a motion ex parte filed by the applicant, the court granted permission for the group to seek “an order of mandamus compelling the respondents to perform their statutory duties as provided for under Section 4 of the Police Act 2020.”

Specifically, the suit is asking the court to compel the police to invite all persons who were last seen with the deceased, particularly his wife, Omowumi Cynthia Aloba; close associates; and his father, Joseph Aloba of Ikorodu, Lagos, who allegedly buried the singer without first obtaining police clearance.

The application further requests that the police arrest and charge any individual found, directly or indirectly, to be responsible for Mohbad’s death, provided that evidence so warrants.

Justice Omotosho also directed that the Originating Summons be served on the Commissioner of Police in Lagos, listed as the third respondent, by substituted means. The court ordered that the processes be delivered by dropping a copy with any officer at the Legal Department of the NPF at the Force Headquarters, Area 11, Garki, Abuja.

At the resumed proceedings on Monday, counsel to the applicant, led by Chief Tunde Falola, informed the court that all respondents in the suit marked FHC/ABJ/CS/636/2026 had been duly served.

Satisfied with the service, the court adjourned the matter to May 28 for hearing.

Reactions from Stakeholders

Legal analysts say the Mohbad death investigation court case could set an important precedent on the enforceability of statutory duties by law enforcement agencies.

A constitutional lawyer who spoke to The iNews Times noted that an order of mandamus, if granted, would legally compel the police to act.

“This is not just about Mohbad. It raises broader questions about accountability and whether citizens or civil society groups can successfully push institutions to perform their statutory responsibilities,” the lawyer said.

Meanwhile, supporters of the late singer have continued to express hope that the judicial process will bring clarity and closure to lingering controversies.

A youth advocate in Abuja described the development as “a significant step towards restoring public confidence.”

“People want transparency. The court’s involvement could help ensure that every loose end is properly addressed,” he added.
